EMIR POHAN WINS LEADING ADVISER AWARD FOR LITIGATION

Emir Pohan has won a prestigious Leading Adviser Award granted by Acquisition International UK (AI). This award has been presented by AI since 2014 to the most renowned and innovative professionals from around the world, covering a wide area of industries, including lawyers, accountants, bankers, and consultants.
This time is the second time Emir Pohan receives international recognition as one of the leading litigation lawyers. He received a similar award from the In-House Community in Hong Kong in 2018.
EMIR POHAN & PARTNERS WINS IN CLASS ACTION LAWSUIT

Several community members in Bojonegara District, Serang Regency, Banten Province have filed a class-action lawsuit against PT. Bandar Bakau Jaya, an Indonesian Port Services Company. The lawsuit hearings initially took place at Serang District Court, but now it has been decided by Banten High Court.
Both the Serang District Court and Banten High Court have granted decisions in favor of PT. Bandar Bakau Jaya.
Mr. Emir Pohan mentioned, "The plaintiff has failed to prove that it suffers damages, and without damages, there was no case. I am pleased with the verdict."
Mr. Emir Pohan also mentioned that his client, PT. Bandar Bakau Jaya is pleased with the court decisions.
ALFAMART APPOINTS EMIR POHAN & PARTNERS TO RESTRUCTURE ITS FRANCHISE DOCUMENTS

PT. Sumber Alfaria Trijaya, Tbk, the owner of Alfamart, an Indonesian prominent convenience store chain, has appointed EMIR POHAN & PARTNERS to restructure legal documents relating to its franchise arrangement.
The work is expected to be completed this year.
EMIR POHAN & PARTNERS SUCCESSFULLY RECLAIMED CLIENT'S AIRCRAFT

In a dispute between a Singapore company Birchmond, Pte.Ltd against one of its lessee, a team of lawyers from EMIR POHAN & PARTNERS has successfully retake Birchmond’s aircraft from the possession of the lessee as a speedy relief.
This dispute has arisen since the lessee has failed to pay installments, which are due according to the aircraft’s sale agreement.
The repossession process took place in Nabire District Court, Papua, and had been carried out under the Indonesian Aviation Law and the Cape Town Convention.
According to Indonesian aviation law expert, Mr. Muhammad Ikhsan, this is the first time a repossession of aircraft as a speedy relief has been successfully carried out through a court order. He also mentioned that this case is a good precedent for Cape Town Convention compliance in Indonesia.
